Workshop on Global Migration Crisis in Bosnia and Herzegovina

On October 6-7, 2022, AIPG's Mediterranian Basin Programs (MBP) organized a workshop entitled "Atrocity Prevention during a Global Migration Crisis. Challenges and Lessons Learned from Bosnia and Herzegovina," as part of the "Atrocity Prevention during a Global Migration Crisis in Bosnia and Herzegovina" project. The event complemented the two online training programs on the intersection of atrocity prevention and immigration policy. The first six-week training, "Foundations in Atrocity Prevention," took place between April 4 - May 15, 2022, and set the foundations for a more specific discussion on the opportunities and challenges of the migration phenomenon in Bosnia and Herzegovina. These challenges then served as the main topic for the subsequent four-week program, "Migrations and Atrocity Prevention," which ran from May 30 - June 26, 2022. The October–workshop provided around 30 participants (course participants and other guest experts) the opportunity to meet for the first time in person after ten weeks of virtual interaction on AIPG's teaching platform and in additional Zoom meetings. Among the participants were working and leadership level representatives of the Ministry of Justice of Bosnia and Herzegovina, the Institution of Human Rights Ombudsperson, Government of Canton Sarajevo, and security sector institutions (State Investigation and Protection Agency, Directorate for Coordination of Police Bodies of Bosnia and Herzegovina, Service for Foreigner's Affairs, Ministries of Internal Affairs of the Federation of Bosnia and Herzegovina, Republika Srpska, and the Canton Sarajevo), involved in decision-making on migrant, asylum seeker, and refugee protection policies. They were joined by members of the academia, from the University of Sarajevo, and of the civil society sector working directly in the field with vulnerable groups. Several experts set the framework for the two-day debate to identify best practices, and remaining systemic challenges in managing migration flows in Bosnia and Herzegovina. Dr. Gabriela Ghindea, AIPG's Mediterranean Basin Programs Director, commended attendees on their commitment to preventing violence against vulnerable migrant populations and explained the overarching goals of the program:

  1. To familiarize key stakeholders with the process by which atrocities occur and its connection to institutionalized discrimination, including unequal access for marginalized groups, with a specific focus on migrant populations;
  2. To strengthen national capacities by developing and supporting the appropriate tools and policies aimed at protecting migrant populations;
  3. To help create and strengthen innovative networks of State and civil society actors who work on long-term collaborative strategies to reduce the risk of atrocities against migrant populations and initiate transparent and independent actions to prevent this type of violence.

Mr. Mersudin Pružan, Prosecutor of the BiH Prosecutor's Office, provided a comprehensive overview of strategic documents that refer to the migration phenomenon through a possible atrocity prevention lens, highlighting the efforts undertaken by the Ministry of Security in cooperation with international organizations to address challenges faced by migrants (e.g., human trafficking). At the same time, he noted that there are persisting discrepancies between the adopted legal framework and its implementation in reality. Dr. Nedim Kulenović from the Association "Vaša Prava BiH" summarized in discussion with the audience problem clusters identified by his organization, assessing at the same time the level of their solvability, given the complex decision-making process in the country. Ms. Lejla Hrustanović, representing the Delegation of the European Union and the Office of the European Union Special Representative in Bosnia and Herzegovina, provided a chronological synthesis of the various support mechanisms through which the European Union assists the State in managing the migration flows. Their remarks sparked vivid discussions moderated by Dr. Olivera Simić, who also acted as an instructor in the training courses, and Ms. Maida Ćehajić, the project coordinator in Bosnia and Herzegovina. The valuable insights and the recommendations formulated by all participants in the workshop will support the development of a baseline report on the situation of migrants in the country with recommendations for policy solutions to the challenges identified over the process, including the identification of opportunities for the governmental institutions, to integrate into their own policies the solutions that fit their mandate and capacities.

Los días 6 y 7 de octubre de 2022, el Programas de la Cuenca del Mediterráneo (MBP) de AIPG organizó un taller titulado “Prevención de atrocidades durante una crisis migratoria global. Desafíos y lecciones aprendidas de Bosnia y Herzegovina”, como parte de su proyecto sobre “Prevención de atrocidades durante una crisis migratoria global”.

El evento se sumó a los dos programas de capacitación en línea sobre la intersección entre la prevención de atrocidades y la política de inmigración. La primera capacitación de seis semanas, “Fundamentos en la prevención de atrocidades”, se realizó entre el 4 de abril y el 15 de mayo de 2022, y sentó las bases para un debate más específico sobre las oportunidades y los desafíos del fenómeno migratorio en Bosnia y Herzegovina. Estos retos sirvieron como eje del programa posterior de cuatro semanas, “Migraciones y prevención de atrocidades”, que se impartió del 30 de mayo al 26 de junio de 2022.

El taller de octubre proporcionó a unos 30 participantes (participantes en el curso y otros expertos invitados) la oportunidad de reunirse por primera vez en persona tras diez semanas de interacción virtual en la plataforma de enseñanza de AIPG y en reuniones adicionales de Zoom. Entre los participantes se encontraban representantes del Ministerio de Justicia de Bosnia y Herzegovina, de la Institución del Defensor de los Derechos Humanos, del Gobierno del Cantón de Sarajevo y de instituciones del sector de la seguridad (Agencia Estatal de Investigación y Protección, Dirección de Coordinación de los Cuerpos Policiales de Bosnia y Herzegovina, Servicio de Asuntos de Extranjería, Ministerios del Interior de la Federación de Bosnia y Herzegovina, de la República Srpska y del Cantón de Sarajevo), implicados en la toma de decisiones sobre políticas de protección de inmigrantes, solicitantes de asilo y refugiados. A ellos se unieron miembros del mundo académico, de la Universidad de Sarajevo, y del sector de la sociedad civil que trabajan directamente sobre el terreno con grupos vulnerables.

Varios expertos establecieron el marco para el debate de dos días con el fin de identificar las mejores prácticas y los desafíos sistémicos restantes en la gestión de los flujos migratorios en Bosnia y Herzegovina.

La Dra. Gabriela Ghindea, Directora de Programas de la Cuenca del Mediterráneo de  AIPG, elogió a los asistentes por su compromiso con la prevención de la violencia contra las poblaciones migrantes vulnerables y explicó los objetivos generales del programa:

  1. Familiarizar a los principales interesados con el proceso por el que se producen las atrocidades y su conexión con la discriminación institucionalizada, incluida la desigualdad de acceso de los grupos marginados, con especial atención a las poblaciones migrantes;
  2. Reforzar las capacidades nacionales desarrollando y apoyando las herramientas y políticas adecuadas para proteger a las poblaciones migrantes;
  3. Ayudar a crear y fortalecer redes innovadoras de actores estatales y de la sociedad civil que trabajen en estrategias de colaboración a largo plazo para reducir el riesgo de atrocidades contra las poblaciones migrantes e iniciar acciones transparentes e independientes para prevenir este tipo de violencia.

El Fiscal Mersudin Pružan, de la Fiscalía de Bosnia y Herzegovina, ofreció una visión general de los documentos estratégicos que se refieren al fenómeno de la migración a través de una posible lente de prevención de atrocidades, destacando los esfuerzos realizados por el Ministerio de Seguridad en cooperación con las organizaciones internacionales para abordar los retos a los que se enfrentan los migrantes (por ejemplo, la trata de personas). Al mismo tiempo, señaló que siguen existiendo discrepancias entre el marco jurídico adoptado y su aplicación en la realidad.

El Dr. Nedim Kulenović, de la Asociación “Vaša Prava BiH”, resumió en el debate los problemas identificados por su organización, y evaluó al mismo tiempo el nivel de capacidad de resolución, dado el complejo proceso de toma de decisiones en el país. Por su parte, Lejla Hrustanović, en representación de la Delegación de la Unión Europea y de la Oficina del Representante Especial de la Unión Europea en Bosnia y Herzegovina, ofreció una síntesis cronológica de los diversos mecanismos de apoyo a través de los cuales la Unión Europea asiste al Estado en la gestión de los flujos migratorios.

Las observaciones de los participantes suscitaron interesantes debates moderados por la Dra. Olivera Simić, que también actuó como instructora en los cursos de formación, y por Maida Ćehajić, coordinadora del proyecto en Bosnia y Herzegovina. Las ideas y recomendaciones formuladas por todos los participantes en el taller servirán para elaborar un informe de referencia sobre la situación de los migrantes en el país, con recomendaciones de soluciones políticas para los retos identificados a lo largo del proceso, que incluyen la identificación de oportunidades para que las instituciones gubernamentales integren a sus políticas las soluciones que se adecuen a su mandato y capacidades.
